Excessify User Agreement

1. Introduction

1.1 Excessify is a subscription-based customer relationship management system designed for surplus funds recovery businesses. It may include CRM access, surplus funds lists, foreclosure and tax sale auction data, lead delivery, outreach tools, and related services (collectively, the “Services”).

1.2 This Agreement governs your use of Excessify and all services provided by Excess Quest, whether accessed through a website, application, or third-party integration.

2. Eligibility

2.1 You represent that you are at least 18 years old and legally capable of entering into this Agreement.

2.2 You confirm that you are using Excessify for lawful business purposes and in compliance with all applicable federal, state, and local laws.

3. Subscription Services

3.1 Free Trial

Excess Quest may offer a complimentary 3-day free trial at its discretion. You may cancel the free trial at any time by emailing eqleads@excessquest.com before the trial period ends.

3.2 Billing After Trial

If you do not cancel before the end of the trial period, your selected subscription will automatically convert to a paid plan. All charges are final and non-refundable once billed.

5. Cancellation and Termination

5.1 Cancellation: You may cancel your subscription at any time by emailing eqleads@excessquest.com. Cancellation stops future billing but does not entitle you to a refund for the current billing period.

5.2 Termination: Excess Quest reserves the right to suspend or terminate access for violations of this Agreement, misuse of Services, or fraudulent activity.

8. Acceptable Use

You agree not to:

• Use Excessify for unlawful purposes
• Violate TCPA, DNC, or data privacy laws
• Scrape, resell, or redistribute data without authorization
• Attempt to reverse engineer the platform

12. Limitation of Liability

Excess Quest shall not be liable for indirect, incidental, or lost profit damages. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.
